Permanent sovereignty over natural resources such gas and oil has emerged as a fundamental principle in international law, allowing all states to assert full authority over their natural resources found within the limits of their jurisdiction (Wagner & Armstrong, 2010 p24). The inequitable distribution of natural resources throughout the globe and their finite character has promoted strong competition to obtain access to these resources; this is because they are of uttermost significance to the survival and development of the world economy. Since a majority of these resources such as oil and gas are located in developing countries, a lot of opportunities for inequitable and unfair exploitation emerges between the state and foreign companies.
