Jury nullification takes place following a jury's return of "Not Guilty" verdict although evidence and applicable law may suggest otherwise-that the defendant is indeed guilty. Effectually, the jury nullifies a law that it believes is incorrectly applied to the case they are presiding over (Murchison, 2012). For instance, whereas smoking of bhang may be illegal, the offender may appeal stating that they used it as a medication. Then a jury presiding over such a case may decide to render the current law governing usage of bhang oppressive and declare the defendant not guilty.
